These Terms of Service govern your access to and use of the KAGO website, online store, products, content, and related services.
KAGO is operated by K ART GLORY Co., Ltd. References to "KAGO," "we," "us," or "our" refer to K ART GLORY Co., Ltd.
By placing an order, creating an account, or otherwise using services that require your agreement, you agree to be bound by these Terms of Service. If you do not agree to these Terms, you must not place an order or use services that require acceptance of these Terms.
Our online store is hosted on Shopify, which provides the e-commerce platform that enables us to offer our products and services to customers.
1. ELIGIBILITY
You must be of legal age in your country or region to use this website and enter into a purchase contract.
If you are under the legal age of majority, you may use the website only with the consent and supervision of a parent or legal guardian.
By placing an order, you confirm that the information you provide is accurate, complete, and current.
2. PRODUCTS AND SERVICES
KAGO offers art objects, artist-inspired products, limited-edition goods, made-to-order products, merchandise, and other products related to Korean art and culture.
We make reasonable efforts to display product descriptions, dimensions, materials, colors, edition information, and images as accurately as possible.
However, the appearance of colors may vary depending on the customer's screen settings, lighting conditions, and viewing environment.
Where clearly disclosed on the product page, minor differences in texture, surface finish, color, placement, or handcrafted details may occur and may be considered part of the individual character of the product rather than a defect.
Such variations do not affect any mandatory consumer rights relating to defective, damaged, or incorrectly supplied products.
3. ARTISTIC AND INTELLECTUAL PROPERTY RIGHTS
Protectable content displayed through KAGO, including but not limited to:
• Artwork images
• Artist biographies, signatures, and related materials
• Product designs
• Photographs and videos
• Text and storytelling content
• Graphics and illustrations
• Logos and trademarks
• Packaging designs
• Exhibition materials
• Certificates and edition information
is owned by or lawfully licensed to KAGO, K ART GLORY Co., Ltd., the relevant artist, photographer, designer, or other rights holder, to the extent protected by applicable law.
Purchasing a physical product does not transfer any copyright, trademark, portrait right, moral right, reproduction right, licensing right, or other intellectual property right associated with the artwork or product.
Unless prior written permission has been obtained from KAGO and the relevant rights holder, customers may not:
• Copy or reproduce artwork images
• Create derivative products
• Use product images for commercial purposes
• Manufacture or sell unauthorized merchandise
• Mint or distribute digital tokens or NFTs based on the artwork
• Use an artist's name or image to imply sponsorship or endorsement
• Remove, reproduce, or misuse certificates, edition numbers, signatures, or authentication materials
Ownership of the physical product and ownership of the intellectual property embodied in that product are separate.
Nothing in these Terms is intended to prevent a lawful owner from reselling a physical product where such resale is permitted by applicable law. However, the resale must not falsely imply authorization, partnership, authentication, or endorsement by KAGO or the artist.
4. LIMITED-EDITION PRODUCTS
Certain products may be released in limited quantities or as numbered editions.
Where applicable, edition numbers, artist information, certificates, packaging, and accompanying materials form part of the product.
Edition numbers, certificates of authenticity, signatures, and other authentication materials must not be copied, altered, fraudulently reused, or used to misrepresent the authenticity, edition, or origin of another product.
KAGO does not guarantee that a limited-edition product will increase in value or maintain any particular resale value.
Any statements regarding artistic significance, collectibility, scarcity, or the artist's career are provided for informational and cultural purposes and do not constitute financial or investment advice.
5. ORDERS
When placing an order, you agree to provide accurate billing, shipping, contact, and payment information.
After an order is submitted, you may receive an electronic order confirmation. This confirmation acknowledges receipt of the order.
We may reject, suspend, or cancel an order for legitimate reasons, including:
• Payment failure
• Incorrect customer or delivery information
• Suspected fraud or unauthorized payment
• Inventory or production errors
• An obvious pricing or description error
• Export, import, sanctions, or legal restrictions
• Inability to deliver to the selected destination
• An order reasonably suspected to be for unauthorized commercial resale
If we cancel an order after payment has been received, we will issue a refund in accordance with applicable law.
We may limit the quantity of products purchased per customer, household, payment method, or order where reasonably necessary to protect limited editions, product availability, artist rights, or fair access for customers.
6. MADE-TO-ORDER AND CUSTOMIZED PRODUCTS
Certain KAGO products are produced only after an order has been placed.
Estimated production periods will be stated on the product page or communicated separately.
Production and delivery dates are estimates and may be affected by material availability, production conditions, artist approval, quality inspection, customs procedures, or circumstances beyond our reasonable control.
Products individually personalized, engraved, resized, modified, or created according to a customer's specific request may be subject to cancellation and return restrictions where permitted by applicable law.
Any such restriction will be disclosed before purchase and, where legally required, separately agreed to by the customer before production begins.
For orders governed by Korean law, a cancellation or return restriction for individually made products will apply only where accepting the return would be expected to cause KAGO irrecoverable material loss, the restriction was separately disclosed before purchase, and the customer provided written or electronic consent before production began.
7. PRICES AND PAYMENT
Product prices are displayed in the currency selected or shown on the website.
Unless otherwise stated, prices may not include:
• International shipping charges
• Import duties
• Customs charges
• Brokerage fees
• Local taxes
• Payment-provider fees
• Currency conversion charges
The final amount available at checkout will include the charges collected directly by KAGO.
Charges imposed separately by customs authorities, banks, card issuers, PayPal, payment providers, or local government authorities may not be controlled by KAGO.
You authorize KAGO and its payment-service providers to charge the selected payment method for the total amount shown at checkout.
We reserve the right to correct an obvious pricing, calculation, or product-description error, subject to applicable law. Where an affected order cannot be fulfilled, the customer will be notified and any payment received will be refunded.
8. SHIPPING AND DELIVERY
Shipping destinations, processing periods, estimated delivery times, shipping charges, and related conditions are described in our Shipping Policy.
Delivery estimates are not guaranteed delivery dates unless we expressly agree otherwise in writing.
Customers are responsible for providing a complete and accurate delivery address.
KAGO is not responsible for delays or additional costs caused by:
• Incorrect or incomplete delivery information
• The customer's failure to receive or collect a shipment
• Customs inspection or clearance
• Import restrictions
• Severe weather
• Carrier disruption
• Strikes, war, civil disturbance, natural disasters, or other events beyond our reasonable control
Nothing in this section limits rights that customers may have under mandatory consumer law.
9. IMPORT DUTIES AND CUSTOMS
For international orders, the customer may be considered the importer of record and may be responsible for complying with the laws and import requirements of the destination country.
Import duties, taxes, customs charges, brokerage fees, and related expenses are generally the customer's responsibility unless otherwise stated during checkout.
If a shipment is refused, abandoned, or returned because the customer did not pay customs charges or complete an import procedure, actual shipping, customs, storage, return, and handling costs may be deducted from the refund where permitted by law.
10. CANCELLATIONS, RETURNS, AND REFUNDS
Order cancellations, returns, exchanges, damaged products, and refunds are governed by our Returns & Refunds Policy.
The Returns & Refunds Policy forms part of these Terms of Service.
Where applicable consumer law provides rights that are more favorable to the customer than our published policy, the mandatory legal rights will apply.
11. PERSONAL INFORMATION
The collection, use, storage, processing, and disclosure of personal information are governed by our Privacy Policy.
By using the website or placing an order, you acknowledge that your information may be processed by KAGO and by service providers necessary to operate the store, process payments, prevent fraud, and fulfill deliveries.
These service providers may include Shopify, payment processors, delivery companies, customs-service providers, analytics providers, and customer-support services.
12. ACCURACY OF INFORMATION
We make reasonable efforts to ensure that information on the website is accurate and current.
However, the website may occasionally contain typographical errors, inaccuracies, omissions, outdated information, or technical errors relating to:
• Product descriptions
• Dimensions
• Materials
• Availability
• Prices
• Promotions
• Shipping charges
• Production times
• Delivery estimates
We may correct or update such information when reasonably necessary, subject to applicable law.
Information relating to artists, exhibitions, cultural interpretation, or artistic value may include curatorial opinions and should not be interpreted as a guarantee of financial value, future recognition, or investment return.
13. PROHIBITED USES
You must not use the website, products, content, or services:
• For any unlawful or fraudulent purpose
• To infringe intellectual property or privacy rights
• To reproduce or commercially exploit artwork without permission
• To distribute malware, viruses, or harmful code
• To interfere with the security or operation of the website
• To collect customer or website data without authorization
• To impersonate KAGO, an artist, or another person
• To submit false or misleading information
• To conduct unauthorized resale using KAGO's branding
• To remove copyright, trademark, edition, or authentication notices
• To harass, threaten, discriminate against, or harm another person
• To circumvent purchase limits or security measures
We may restrict or terminate access to the website where a user materially violates these Terms or applicable law.
14. THIRD-PARTY SERVICES AND LINKS
The website may contain services, tools, payment methods, applications, or links provided by third parties.
KAGO does not control all third-party websites or services and is not responsible for their independent terms, privacy practices, content, availability, or security.
Customers should review the terms and policies of any third-party service before using it.
The inclusion of a third-party link does not necessarily mean that KAGO endorses or guarantees that third party.
15. DISCLAIMER OF WARRANTIES
We will provide products and services with reasonable care and in accordance with the descriptions and commitments made through the website.
Except for warranties, guarantees, and rights that cannot legally be excluded, the website and its content are provided on an "as available" basis.
We do not guarantee that:
• The website will always be uninterrupted or error-free
• Every product will remain continuously available
• A product will increase in artistic or financial value
• Website content will meet every customer's subjective expectation
• Third-party services will operate without interruption
Nothing in these Terms excludes or limits any statutory warranty, consumer guarantee, right of withdrawal, remedy for defective goods, or other mandatory right that applies to the customer.
16. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, KAGO will not be liable for indirect, incidental, special, punitive, or consequential losses arising from the use of the website or products.
This may include loss of profit, loss of opportunity, loss of data, business interruption, or loss caused by an unauthorized commercial use of the product.
KAGO's liability will not be excluded or limited where such exclusion is prohibited by law, including liability arising from:
• Fraud or intentional misconduct
• Gross negligence
• Death or personal injury caused by legally attributable negligence
• Defective products where statutory liability applies
• Violation of mandatory consumer rights
Where liability may legally be limited, KAGO's total liability relating to a particular order will not exceed the amount paid by the customer for that order, except where applicable law requires otherwise.
17. INDEMNIFICATION
To the extent permitted by law, you agree to compensate KAGO for reasonable losses, liabilities, or expenses resulting from your unlawful use of the website, infringement of intellectual property rights, fraudulent conduct, or material violation of these Terms.
This provision does not apply where the loss was caused by KAGO or where such an obligation would be prohibited under applicable consumer law.
18. FORCE MAJEURE
KAGO will not be responsible for a delay or failure caused by circumstances beyond our reasonable control.
Such circumstances may include natural disasters, fire, flood, epidemic, war, civil disturbance, government action, import or export restrictions, labor disputes, carrier interruption, material shortages, power outages, or failures of communication and payment networks.
We will take reasonable steps to notify affected customers and resume performance where possible.
19. TERMINATION
We may suspend or terminate access to the website where a user engages in fraud, unlawful conduct, abuse, security interference, infringement of intellectual property rights, or a material violation of these Terms.
Termination does not affect rights and obligations that arose before termination.
Sections concerning payment, intellectual property, liability, dispute resolution, and other provisions intended to survive termination will remain effective.
20. SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary.
The remaining provisions will continue in effect.
21. NO WAIVER
A failure by KAGO to enforce a provision of these Terms does not constitute a permanent waiver of that provision or any other right.
22. ENTIRE AGREEMENT
These Terms, together with our:
• Returns & Refunds Policy
• Privacy Policy
• Shipping Policy
• Legal Notice
• Product-specific notices
• Any additional terms expressly agreed during an order
form the agreement between the customer and KAGO concerning use of the store and purchase of products.
If product-specific terms conflict with these general Terms, the product-specific terms will apply to that product, provided they comply with applicable law.
23. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by the laws of the Republic of Korea.
However, customers will retain the protection of any mandatory consumer law applicable in their country or region that cannot legally be excluded by agreement.
The parties should first attempt to resolve any complaint or dispute through good-faith communication.
If a dispute cannot be resolved, it may be submitted to a competent court or consumer-dispute resolution body in accordance with applicable jurisdiction and consumer-protection rules.
Nothing in these Terms requires a consumer to waive a mandatory right to bring a claim in a court or forum available under applicable law.
24. CHANGES TO THESE TERMS
We may revise these Terms to reflect changes in our services, business operations, technology, or applicable law.
The updated version will be posted on this page with a revised effective date.
Changes will not retroactively reduce rights relating to an order already completed unless required or permitted by law.
Continued use of the website after the updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.
